Rubio was born in Miami, Florida, the son of Cubans who immigrated to the United States prior to the rise of Fidel Castro, eventually becoming naturalized citizens themselves. He attended South Miami Senior High School, graduating in 1989. He then attended Tarkio College in Missouri for one year on a football scholarship from 1989 to 1990, before returning to Florida, enrolling at Santa Fe Community College, the University of Florida, where he obtained a Bachelor of Arts degree in political science in 1993, and the University of Miami School of Law, obtaining his J.D. degree cum laude in 1996.

While studying law, Rubio interned for U.S. Representative Ileana Ros-Lehtinen, also working for Republican Senator Bob Dole’s 1996 presidential campaign. In 1998, two years after graduating law school, Rubio was elected to a seat as City Commissioner for West Miami. In early 2000, he moved on to the Florida House of Representatives. In 2002, he won re-election to a second full term unopposed. Spending almost nine years in the Florida House of Representatives, he also won re-elections in 2004 and 2006. By 2005, he rose to the position of speaker of the Florida House of Representatives, becoming the first Cuban American to rise to the position, being sworn in a year later, remaining in the position until 2008.
