Daniel Hamilton Magee, an 18-year-old
student at the University of Texas-Austin, has been arrested for aggravated assault with a deadly weapon following the shooting at the Sigma Chi fraternity house over the weekend. During the altercation in the fraternity house, security guard Edward Earls was shot in the foot.
Here’s how it went down, according to the Austin-American Statesman:
The report said members of the fraternity asked an on-site security guard, Edward Earls, to kick Magee out because he was causing problems.
“Magee became upset and had to be physically removed by Earls,” the document said. “When Magee got to the front gate of the fraternity house Magee made verbal threats to return to the party with an AK-47 rifle and shoot up the place.”
About 45 minutes later, Magee returned with two others.
Witnesses told investigators one of the men pulled out a gun and fired one round at Earls, striking him in the foot, the affidavit said.
Apparently, right after the shooting the Austin SWAT team showed up and arrested Daniel and his two roommates. It’s unknown whether or not the apartments allowed for concealed carry guns, like the entire campus of UT-Austin does. We’re just happy that no one was killed.
Update: An earlier report of the story stated that Daniel is a student at UT-Austin. He is not.
