Judge Monte Watkins, the judge presiding over the Vanderbilt rape case against Brandon Vandenburg and Cory Batey has declared a mistrial. According to this court order, the mistrial was declared because the jury foreman hadn’t disclosed he was once a victim of a sexual assault.
Brandon and Cory were both found guilty of raping an unconscious woman in 2013, but the sentencing was pushed back until today.
Two other ex-Vanderbilt students Brandon E. Bank’s and Jaborian “Tip” McKenzie are also awaiting trial for the rape. Their trial has not yet begun yet.
What happens now to Brandon and Cory is up to the judge, but it’s unlikely that the state will let these two off the hook that easily just because someone on the jury wasn’t completely honest. What will likely happen is that there will be a new trial.
As far as the juror is concerned, he’s likely in a solid amount of trouble himself.
